At PhyxMe Physiotherapy and Rehabilitation (“PhyxMe”) we are dedicated to providing every client with the highest standard of service. Please find listed below the pertinent terms and policies consistent with best practice standards within our practice.

This document also explains our position and specific conditions regarding your use of our internet or “web” sites (collectively, “site” or “sites”). By using this site, you agree to be bound by our Terms of Business and Privacy Policy, in addition to other terms and conditions that may appear throughout our sites.

PhyxMe reserves the right to change, add or remove any conditions in the stated policies as we feel necessary and appropriate or as impacted by associated regulatory bodies, to enable the most efficient and professional administration in our practice. Each time you use this site, you should visit and review the then-current notices and policies that apply to your transactions and use of this site. If you do not agree to be bound by the then-current notices and polices, your sole remedy is not to use this site. PhyxMe is not responsible for typographical or photographic errors on this site (see “Product display and colours” and “Errors on site” for more information).

Please understand that our policies aim to allow equality of service to all clients and it is not our intention to exclude anybody from being able to access our services. Referrals

For private fee clients a medical referral is not required to see a physiotherapist. Clients who are eligible for Compulsory Third Party (CTP) or Workcover funding, you must provide a medical referral (general practitioner, sports physician, orthopaedic surgeon) for treatment, as part of the claims process. However, there are certain other conditions that must be met before a third party can be billed/pay for your appointment. Clients issued with Gold/White cards from the Department of Veterans Affairs (DVA) may be eligible for subsidised treatment when presenting with an appropriate medical referral, within the previous twelve months (in accordance with current DVA policy). Clients wishing to receive allied health services under a Medicare Australia subsidised plan must have current Medicare Australia coverage, their Medicare card must in date and they will require referral from their treating general practitioner. There are other specific conditions that must be met to access Medicare rebate.

Billing and accounts

It is a requirement that all fees are paid at the time of consultation. We accept cash, cheques, EFTPOS, credit cards (excluding American Express and Diners). If you have private health insurance, you will need to provide your membership card on the day of service in order to receive an on-the-spot rebate. If for some reason your account is outstanding, at the end of each month a fully itemised account will be issued, with payment terms strictly 7 days. Failure to render full payment within these terms will result in your account being referred to a collection agency. Any additional debt recovery costs will be added to your account.

Cancellation policy

To assist in reminding you of your appointments PhyxMe can supply you with an appointment card and/or a SMS message reminder to your mobile (optional). A 24-hour cancellation policy applies to your consultation appointment times. Failure to provide 24 hours notice when changing appointments will result in a $45 fee. This fee will be charged to your account and will need to be paid prior to subsequent appointments. If you are unable to attend your scheduled appointment, the practice will, when able, provide you with an alternative appointment time on your scheduled day of service, so as to avoid a cancellation fee being charged.

Late and missed appointments

Clients arriving late to an appointment, but within their appointed time slot, may receive a shorter consultation in an effort not to inconvenience other clients waiting. These shorter consultations as well as missed appointments, are charged at the full consultation fee.

Workers compensation claims

Clients who believe they are eligible for Workcover funding must ensure they satisfy the following criteria before requesting third party billing: 1) The injury occurred directly in relation to their current gainful employment 2) The injury has been reported to their employer and all necessary internal paperwork has been completed 3) You have seen an appropriate medical officer (general practitioner, sports physician, orthopaedic surgeon) and have been referred to physiotherapy. At your initial consultation, please present the following to our administration staff: 1) A referral from your medical officer 2) Employer’s name and contact details 3) Your employer’s insurance company name 4) Your insurance claim number (if it has been provided). In the case of Workcover/CTP claims, the individual client will always be ultimately responsible for payment of all accounts, in the event the involved Insurer does not accept financial liability for our services provided. We reserve the right to discontinue providing treatment through Workcover/CTP funding if we feel a claimant is acting fraudulently or demonstrating non-compliance.

Compulsory Third Party (CTP) Claims

Clients who believe they are eligible for Compulsory Third Party Insurance funding must ensure they satisfy the following criteria before requesting third party billing: 1) The injury occurred directly in relation to a motor vehicle accident 2) The injury has been reported to the police and all necessary paperwork has been completed 3) You have seen an appropriate medical officer (general practitioner, sports physician, orthopaedic surgeon) 4) A claim number has been issued to you by the involved insurance company. At your initial consultation, please present the following to our administration staff: 1) A referral form from your medical officer 2) Your CTP Insurance company name and the claim number that has been provided to you. The individual client will be required to pay all consultation fees involved until the claimant has been issued and verified by the relevant CTP insurance company. We reserve the right to discontinue providing treatment through Workcover / CTP funding if we feel a claimant is acting either fraudulently or demonstrating non-compliance.

Refunds

PhyxMe has a 100% money back guarantee if a client is not satisfied with their physiotherapy or massage treatments. Certain products we sell may have warranty and exchange/refund policies. These will be outlined at the time of purchase. If a client purchases a product from PhyxMe which then becomes faulty through no form of disuse or damage by the purchaser, they are encouraged to return the product to the clinic for assessment and management on a product by product basis.

Privacy Policy

PhyxMe has a Privacy Policy Statement [insert link], with the practice bound by the Privacy and Personal Information Protection Act (1998) and Health Records and Information Privacy Act (2002) and operates in accordance with the Code of Conduct of the Australian Physiotherapy Association.

Complaints and disputes

PhyxMe handles all complaints in accordance with our Complaints Handling Policy. To obtain a copy of this policy please contact our Team Leader Lindsey McKay (phyxme@phyxme.com.au). If there are any dispute regarding this Site, you agree that the dispute will be governed by the laws of the State of Queensland without regard to its conflict of law provisions. You agree to personal jurisdiction and venue in the state and federal courts of the State of Queensland.

Disclaimer of warranties

You expressly agree that your use of this site is at your sole risk. This site is provided on an “as is” and “as available” basis. PhyxMe and its officers, directors and employees, as well as its third-party agents, contractors, distributors, merchants or sponsors (collectively, “third parties”), cannot and do not warrant that your use of this site will be uninterrupted, secure, or error-free. Neither PhyxMe nor its third parties have any responsibility for your action or inaction in connection with this site or for any damage to your computer or data or any other damage you may incur in connection with your use of this site. Neither PhyxMe nor its third parties warrant the accuracy, integrity or completeness of the content provided on this site nor the products or services offered for sale on this site. PhyxMe and its third parties specifically disclaim all warranties, whether express or implied, including warranties of title, merchantability, and fitness for a particular purpose, title and non-infringement. No oral or written information or advice given by PhyxMe or its third parties shall create a warranty, except where the exclusion or limitation of certain warranties is prohibited by law.

Limitation of liability

Under no circumstances shall PhyxMe or its third parties be liable for any direct, indirect, incidental, special or consequential damages that result from your use or inability to use this site, including your reliance on any information obtained from this site that results in mistakes, omissions, interruptions, deletion or corruption of files, viruses, delays in operating or transmissions, or any failure of performance. The foregoing limitation of liability shall apply in any action, whether in contract, tort or any other claim, even if an authorised representative of PhyxMe has been advised of or should have knowledge of the possibility of such damages. By your use of this site, you acknowledge that this paragraph shall apply to all content, merchandise and services available through this site, except where the exclusion or limitation of incidental or consequential damages is prohibited by law.

Limitations regarding information, articles and advice

PhyxMe offers articles, information, and advice through this Site for informational and educational purposes only and is general in nature. PhyxMe provides this information on the understanding that the reader takes responsibility for assessing its relevance and accuracy. This information is not intended to replace or substitute professional medical or allied health advice. You should consult a trained medical professional for consultation, diagnosis and treatment of injuries and any topic covered on this site. Reading the information on this website does not create a therapist-client relationship.

Product display and colours

This Site attempts to display product images as accurately as possible. However, we cannot guarantee that the colour you see matches the product colour. Note that the display of colour may depend, in part, upon the monitor you are using or images supplied by manufacturers.

Errors on site

Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered and PhyxMe reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions, including after an order has been submitted, whether or not the order has been confirmed and/or your credit/debit card has been charged. If your credit/debit card has already been charged for the purchase and your order is cancelled, PhyxMe will issue a credit to your credit/debit card account in the amount of the charge. Individual bank policies will control when this amount is credited to your account.

Pricing

Prices, offers and selection may vary between our clinic retail store and Sites, and are subject to change. We reserve the right to limit sales, including the right to refuse sales.

GST

Because PhyxMe operates within Australia and collects and remits Goods and Services Tax (GST) as required by law, this Site also collects and remits GST as appropriate.

Indemnity

You agree to indemnify and hold PhyxMe and its officers, agents, instructors, employees and other partners and Third Parties harmless from any loss, liability, claim or demand, including reasonable attorney’s fees, made by any other third party due to or arising out of your use of this Site, including your use of this Site to provide a link to another site or to upload content or other information to this Site.
